Five months ago the human rights community in Russia and beyond lost a friend and colleague, Natalya Estemirova, Memorial's lead researcher in the Chechen Republic of the Russian Federation. After her murder on July 15, 2009, Memorial suspended its work in the republic. Since that time, the authorities in Chechnya have continued to intimidate and persecute human rights defenders and those who seek justice for abuses; several were forced to leave Russia due to threats to their lives.

As a result, victims of human rights violations in Chechnya have practically nowhere to turn.

Introduction

The North Caucasus remains one of Russia's least prosperous regions in the field of human rights. Although the situation in various republics and regions of the North Caucasus differs remarkably, some general factors, spread over a large territory of the North Caucasus adversely influence the development of the situation. These are:

− the ongoing fighting. Right now armed underground forces, using terroristic methods, oppose the Russian state on the North Caucasus.

The previous sixth report on the situation of Chechens in Russia covered events through October 2007[1]. There has long been plenty of material for preparing the next yearly report. However, when compiling it we face the problem of safety both for those whose destinies we describe and of those officers of our organization who work in Chechnya.

At night of August 21, 2004 two months after the insurgency of armed fighters to Ingushetia and a week before the appointed elections of the President of the Chechen Republic, large scale military operation was carried out by Chechen combatants in the capital city of Grozny. The monitors of HRC "Memorial" tried to reconstruct the picture of these events by visiting sights, and interviewing witnesses.

According to the evidence collected, the first clashes started soon after 6 p.m.

Chechen IDPs Forced Back to Chechnya: Uchkhoz"in Yandare after June 21

The raid of armed guerilla fighters to Ingushetia on June 21/22 drastically worsened the situation of the forced migrants from Chechnya, who still reside in this republic.

Internally displaced persons are running from the war and terror in Chechnya to Ingushetia, continually facing forceful suppression with the goal of returning the refugees back to Chechnya. This suppression turned particularly cynical and rough in 2003-2004. Mass episodes of arbitrarily removing internally displaced persons from the lists of the Department of Migration of Ingushetia's Ministry of Internal Affairs have become one of type of suppression (further according to the texts from Migration Services of the Republic of Ingushetia).

According to the data of HRC "Memorial" (We are able to carry out monitoring over a limited territory, 25-30 % of Chechnya, thus, the data below is incomplete) in April 2004:

1. Killed: 33 residents of Chechnya (18 civilians, 13 repres. of power agencies, 2 representatives of civilian authorities; 2 alleged members of military armed formations)

2. Kidnapped: 25 residents of Chechnya

The intention of the Russian authorities to return civilians, who fled Chechnya during the military campaign back to the republic became obvious in February 2001. Since then the migration services have exerted systematic pressure on the residents of tent camps in Ingushetia, pressing them to return home. However, in spite of the hard living conditions in tents, IDPs had been reluctant to leave Ingushetia, naming two main obstacles to their return: lack of security and destroyed housing.
