1. GOODS IN TRANSIT PRIOR TO 28 MARCH
2003. The
table of goods in transit details
all confirmed transit cases registered by the Office of the Iraq Programme
as of 25 July 2003. The deadline for goods eligible for consideration as
in transit has been adjusted from 17 March 2003 to 28 March 2003. Suppliers
that had shipped goods to Iraq on or before 28 March 2003 and which are
not included on the table of goods in transit should notify OIP by contacting
the e mail address cpmd-desk@un.org. Suppliers that have been in communication
with OIP and advised that they are not eligible for consideration as a
transit case should not make further contact with OIP, unless their goods
were shipped between 17 March 2003 and 28 March 2003.
2. As outlined in our notice on resolution 1483 (2003) -- Prioritization of contracts, the United Nations, in consultation with the Coalition Provisional Authority (CPA), continues the review of all approved and funded contracts to determine their relative utility and to select appropriate priorities. The total of 1,612 contracts reviewed under paragraph 16 of resolution 1483 (2003) have been finalized and are included in the list of confirmed priorities under resolution 1483 (2003) as at 25 July 2003.
3. It should be noted that the list is not final and will be periodically updated as additional contracts are reviewed and added to the list. The suppliers and permanent missions should consult this web site for periodic updates. The Office of the Iraq Programme (OIP) regrets that it is not in a position to respond to individual queries from suppliers on the prioritization of contracts.
4. Once contracts are included in the list of confirmed priorities under resolution 1483 (2003), the relevant UN agencies and programmes will contact suppliers to negotiate necessary amendments and determine delivery schedule. If necessary, arrangements will be made for issuance or extension of letters of credit. There is no need for individual suppliers to request issuance of letters of credit or their extension, as this will be done automatically when amendments are processed.
5. The United Nations, in consultation with the CPA, will review all approved and funded contracts to determine relative utility of the goods concerned. However, not all contracts agreed to have relative utility will be processed/amended by the United Nations. The United Nations will continue processing amendments for prioritized contracts until 21 November 2003 and will cover as many contracts as possible. Contracts with confirmed relative utility but not amended by the United Nations prior to 21 November 2003 will be transferred to the CPA who will make necessary arrangements for amending the contracts after that date.
6. Contacts with suppliers and subsequent amendment negotiations by the United Nations will be carried out on a "first-come-first-served" basis, depending on the order the contracts have been prioritized. This is to ensure that most urgently needed goods are processed first, as determined by the United Nations in consultation with the CPA. The list of confirmed priorities under resolution 1483 (2003) contains a column marked "Priority Type". If the column is marked "1", this indicates first order of priority and such contracts will be processed before the ones marked "2" or "3" in a particular sector. There is also a column marked "Delivery Date". If that column indicates "immediate" delivery, such contracts will be processed before contracts that have later dates indicated or no date indicated. The list also contains a "Received Date" column and contacts will be made with suppliers based on that date as well -- earlier the date, earlier the contact is established. If a large number of contracts is received for one sector on the same date and all are marked for "immediate" delivery, contacts will be established first with suppliers who have earlier date of issuance for approval letter (O/C letter).
7. The list of confirmed priorities under resolution 1472 (2003) contains a final set of contracts that have been prioritized prior to 3 June 2003 and for which necessary amendments have been made and submitted to the Office of the Iraq Programme as at 18 July 2003. No new contracts will be added to this list and any new priorities will be subject to provisions of resolution 1483 (2003) instead. Contracts that were previously on resolution 1472 (2003) list but with no amendment ever made and/or submitted to the Office of the Iraq Programme, have now been excluded from this list. However, they remain available for prioritization under resolution 1483 (2003) if the UN experts, in consultation with the CPA, decide that the goods still have relative utility.
