Context & Mission

Médecins Sans Frontières (MSF) is an international medical humanitarian organization founded in 1971 that provides impartial humanitarian assistance in more than 70 countries to populations in distress, victims of natural or manmade disasters and to victims of armed conflicts, without discrimination and irrespective of religion, creed or political affiliation.

Responsibilities

Acting as a member of the ILD, the Flying Legal Advisor works in an integrated way with other legal advisors to ensure that MSF receives quality and harmonised support, whilst capitalizing specialized legal expertise and experience.

Under the hierarchical supervision of the Legal Coordinator, and the technical supervision of Unit 2 Manager, the Flying legal advisor is responsible to provide direct legal support to operations via field visits, with regards the medico-legal questions of MSF activities.

Description of main activities

Legal Support to field missions for medico-legal matters and MSF responsibilities towards patients

1. Provide analysis of the legal framework applicable to MSF medical and humanitarian activities for relevant contexts.

2. Provide legal inputs on the question of disclosure of medical information to third parties.

3. Support field teams in the prevention and management of legal risks in relation to medical activities.

4. Support and train missions in the implementation/dissemination/training of the medicolegal toolbox and to develop tools to improve the documentation and management of medico-legal (individual) cases.

5. Contribute the definition and follows up the implementation of archiving system of (highly sensitive) data.

6. Provide legal advices on MSF’s collaboration with national/international investigation mechanisms/courts and (non)judicial investigation bodies

7. Ensure specific implementation of MSF policies on the certification of victims of violence (SV + VoT).

8. Provide legal advice regarding individual cases of requests for mandate/ arrests/ detentions/interrogations of patients in care.

Participation in the ILD

1. Fill out the activity report of the legal department

2. Active member of the intersectional working groups & ILD days

3. Provide inputs for the development and implementation of new guidelines, templates, policies.
