These Instructions are intended to support the tenderers in the preparation of their tenders.
Tenderers will not be reimbursed for any costs incurred in connection with the preparation and submission of their tender.
1. General description
1.1. Purchaser and Suppliers identification
Name: Handicap International Federation
Here in after referred as “HI”
Founded on July, 19th 1982, HI, a non-profit organization governed by the French law on associations of July, 1st 1901, is specialized in the field of disability. HI is an independent and impartial aid organization working in situations of poverty and exclusion, conflict and disaster. We work alongside people with disabilities and vulnerable populations, taking action and bearing witness in order to respond to their essential needs, improve their living conditions and promote respect for their dignity and fundamental rights.
“HI” will only take into consideration suppliers with relevant experience of providing construction services in Kurdistan and in Iraq.
HI is working in Iraq since few years with emergency and development activities in order to answer to the needs of vulnerable populations.
1.3. Purpose of the tender
HI aims, through one or several contracts, to ensure the work of constructing and rehabilitating 2 playgrounds in Haweeja district following HI’s inclusion standards and the instructions of HI site engineer.
2. Tendering procedure
The participation procedure is made up of two stages:
· Stage 1: Tendering phase
· Stage 2: Selection phase
2.1. Publishing information
Publication date: 29.09.2019 (10:00; Iraq Time)
Deadline for receipt of tenders: 20.10.2019 (1600; Iraq Time)
The periods named in these instructions shall be consecutive calendar days.
The suppliers interested in submitting a tender shall send the full offer in a closed/sealed envelope to:

Before the deadline of the 20th October 2019, 16:00 – Iraq Time
The title of the sealed envelope shall be:
IRQ_19_Haweeja Playgrounds Construction/ Name of the supplier “IRAQ – 2019 – LOG – ERBIL – CFT – 001 – Not to be opened before the Tender opening session”.
All the documents must be signed, stamped (each page).

Tenderers may include any additional documents they deem relevant.
The mandatory fields to be completed for each product are:
· Prices for each item in U.S Dollars ($), including tax,
· Delivery period of each line.
Prices should include all the costs to be met by the supplier, transport, loading, and unloading and installation fees.
No other costs of whatever kind may be added to the price.
The materials used for preforming the work should meet the specifications mentioned in document Playgrounds Construction material for each item.
Reductions or modifications to tender files made by tenderers after submission won’t be taken into consideration during the analysis and evaluation of tenders.
Tenders shall remain valid for a period of three (3) calendar months from the deadline for the submission of tenders.
Furthermore, the tenderer must be provided a catalog of all items that can be supplied to HI to meet its occasional requirements.
The quantities in the BoQ are estimation quantities, and the payments will be calculated from the actual works, so the contractor must submit a measurement sheet for the actual works for approval by the HI Reconstruction team/ engineers.
3. Evaluation Process
HI will organize three (3) internal committees to evaluate the tenders and make a selection.
The first committee will evaluate the tenderers according to the administrative criteria.
The second committee will evaluate the tenderers based on the quality of the items proposed by the tenderers.
The third committee will compare the different offers (prices and delivery points).
The final selection for each batch will be completed by this committee.
3.1. Exclusion criteria
· The reception of the tender is after the defined deadline,
· The documents are not completed as per the instructions,
· The documents contain obscure or other irregularities
· Unable to provide, upon request,
· Unable to provide documents in English (quotes, , invoices, technical documentation )
· Who does not have any quality assurance certification (e.g.: ISO/CE/international standard or equivalent),
· The supplier is not able to provide justify of its construction experience.
· The supplier is not registered in Iraq as a construction company.
· Are bankrupt, their affairs are being administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning these matters or are in any analogous situation arising from a similar procedure provided for a national legislation or regulations,
· Have been convicted of an offence concerning professional misconduct by a judgement which has the force of res judicata,
· Have been guilty of gross professional misconduct proven by any means which the HI can justify,
· Have not fulfilled their obligations relating to the payment of social security contributions or the payment of tax in accordance with the legal provisions of the authority or those of the country in which the tenderer is registered,
· Have been the subject of a judgement which has force of res judicata for fraud, corruption, involvement in a criminal organization or any other illegal activity,
· Have been declared to be in serious breach of contract for failure to comply with their contractual obligations,
· Are subject to a conflict of interest,
· Are guilty of misrepresentation in supplying the information required by the HI as a condition of participation in the award procedure or fail to supply this information.
By returning these instructions duly initialed and signed, the tenderers confirm that they are not in one or more of the situations described above and undertake to send to HI within seven (7) calendar days following receipt of a request from any additional documents that HI considers necessary to perform its checks.
3.2. Selection criteria
The selection criteria are based on: the respect of the Good Business Practices, the quality, the price, and the delivery period.
HI has the right to select multiple suppliers.
HI reserves the right not to award the contract concerned by this tendering procedure should circumstances require, and is under no obligation to provide justification or compensation of any kind to the companies consulted.

Requests for further information:
Any questions or requests for further information should be addressed at the latest to the email for questions as stated above by 10th of October 2019 (1700, Iraq Time). The answers will be sent by email to all applicants on 13th of October 2019 till (1700, Iraqi Time).
The tenderers and their staff are obliged to maintain professional secrecy for the entire duration of the process. All reports and documents drawn up or received by the tenderer are confidential.
When reviewing tenders, the committee may, on its own discretion, ask a tenderer to clarify any aspect of the tender.
The tenderers must at all-times act impartially and as a faithful adviser in accordance with the HI – Good Business Practices. Tenderers must refrain from making public statements about the project or services related to any contracts entered into with HI without HI’s prior written approval. This also includes not utilizing HI’s name or logo on any communications material.
Any attempt by tenderers to approach by any way any member of the evaluation committee directly during the evaluation period will be considered legitimate grounds for disqualification from the tender process.
Any attempt by a tenderer to obtain confidential information, enter in unlawful agreements with competitors or influence the committee during the process of examining, clarifying, evaluating and comparing tenders will lead to the rejection of from the tender.
After the opening of the tenders, no information about the examination, clarification, evaluation or comparison of tenders or decisions about the contract award may be disclosed before the signing of the contract(s) by HI and the successful tenderer(s).
The type of the contract proposed is a service agreement contract for one the period of implementation of the project.
Only the signed contract will constitute an official commitment on the part of HI.
HI may visit the successful tenderer of before signing any contract.
The prices specified in the Quotation form correspond to prices and shall remain valid for the whole duration of the contract.
The Contractor should submit reports to HI Reconstruction team/ engineers with the information requested by HI team.
The contractor should be committed to the work plan agreed upon at contract signature.
At each stage of the work's progress, the sites will be assessed jointly by representatives of HI and the Contractor. Completion certificates will be issued by HI after assessment of the sites.
In case of incapacity of the contractor or slowing or delay or prevarication in the implementation of the work/supply, the guarantee of the Supplier (Performance guarantee) 10% of the contract value that should be provided by the supplier also upon signature of the contract will be relegated in favor of HI and without reference to him and this is immediately after the separation of the Contractor’s contract, this is also without consulting him and without any financial compensation. The guarantee will be returned to the supplier after execution of the works under the contract.
7. Time Frame
· Please clearly mention validity of the quotation/financial offer
· The contract is to be singed for a period of one year
· Schedule of work from the supplier, work plan
· Work completion must not exceed more than 45 days for both playgrounds
HI reserves the right to disqualify any offer based on failure of the tenderer to follow solicitation instructions.
HI reserves the right to waive minor proposal deficiencies that can be corrected prior to award determination to promote competition.
Handicap International (HI) in partnership with donors is inviting registered companies to submit tenders for framework agreements for a yearly contract.
Handicap International is looking for a Framework agreement for
- Construction of two (02) playgrounds in Haweeja (Abbasi & Hai Alnidaa)
Interested companies are invited to download tender documents from www.ncciraq.org or to request tender documents directly from Handicap International office in Erbil or Kirkuk (address below). The deadline of submitting the tenders is Sunday 20th 2019 at 1600 hours (Iraqi Time) only in a sealed envelope with the reference and note mention below.

Any tender submission after the deadline will not be considered, Tender submission through email will not be considered.
